*This TOS is for private freelance work only. If you are a studio or organization, please contact me via discord (twistedmoose) or at bull.moose.studios@gmail.com and we can work out a contract to meet your needs.

-You MUST be 18+ to commission me for any type of work, both SFW and NSFW. When you commission me, I assume in good faith that you are 18+. If I learn that you are lying about your age, you will be blacklisted. 

​

-PLEASE maintain a certain level of professionalism when working with me. Keep in mind that I am a business and do not have time to maintain individual friendships with every client. Casual language is totally fine, but please do not vent, share personal information, roleplay, or private message me about topics unrelated to your order. If you would like to socialize, I would be more than happy to direct you to my community discord server. :)

-You MUST provide me a clear visual reference of the subject UNLESS I am working on a character sheet. Clear visual references include: Reference sheets, game screenshots, photos of the subject, and existing art of a character/subject. If you want a character designed, please contact me about ordering a reference sheet.

​

-I offer a progress update at the sketch stage and if necessary at the color/shading block-in stage. Please ask if you want updates beyond the sketch stage.

​

-You will get up to three chances to change anything about your piece. All mistakes on my part will be corrected at any point in the piece. I do not make edits past the color/shading block-in phase unless there was an error on my part. I will not make last-minute changes to a completed piece unless there is an error on my part. Please choose the hourly option if you feel you will need many opportunities to change the piece.

-You will receive a digital file (either .png or .jpg) on discord, email, or google drive upon completion of a commission. You are not receiving a physical product and do not need to provide shipping information.

​

-You may not under any circumstances mint any of my artwork as a Non-Fungible-Token (NFT). Doing so is a breach of contract. You will be blacklisted, and I will seek legal action. I do not do private or commercial projects regarding NFT's

​

-Please understand that I work best when allotted some amount creative freedom. 

​

-I reserve the right to refund you for your commission and end the process of a piece for any reason.

Process

-Flat rate pieces will be paid upfront. I will begin work once payment is made. I am flexible on start/payment dates for your piece depending on your needs.

​

-The customer may make large changes to the piece (pose, composition, subject matter) at the sketch stage. Smaller changes (anatomy/pose tweaks, color/atmosphere, etc) at the color/shading block-in.

​

-Updates will be given via discord, email, or other agreed upon mode of communication.

​

-Major changes to pose/composition cannot be made after the sketch has been approved. 

​

-The customer may receive their final piece either via discord, email, or both depending on their preference.

​

-I will communicate ETA's on updates and deadlines with you depending on the complexity of your order.

​

​

Hourly commissions

-Payment for hourly pieces will be made after the project is complete. 

​

-progress updates will be heavily watermarked.

​

-I will give the customer a timestamp of the hours I have worked and a watermarked image with each update.

​

- The customer may ask for as many changes as desired at any stage under the hourly rate. 

​

-You will receive an unwatermarked copy of the work via email, google drive, or discord once the final payment has been made.

​

Payment

-All payments will be made through Paypal or Venmo in USD unless agreed upon otherwise.

​

- ​If you would like me to work within a budget on hourly pieces, I will communicate with you directly as to how we can fill your order.

-If you fail to pay the agreed upon amount for a piece of artwork, you will be blacklisted. 

​

Cancellation/Refunds

-The customer may request a refund if the piece HAS NOT BEEN STARTED and they would like to cancel, or if I am unable to process your commission in time. Refunds are not available otherwise.

​

- If at any point you must cancel an hourly commission, I will send an invoice with the hours I have worked. Once that is paid, I will send an unwatermarked file of what I have finished so far.

​

-I reserve the right to cancel and refund a piece at any point in the commission process.

​

Intellectual Property

Artist

-By commissioning me, you are purchasing my labor. I retain copyright over all my work, which includes but is not limited to the right to redistribute, reproduce, or reuse my work for marketing and self promotion, unless otherwise agreed upon.

​

​-I will respect your request to not publicly post your commission, no explanation necessary.

​

-I reserve the right to redistribute my artwork for personal and commercial use unless agreed otherwise.

-I reserve the right to modify and resell any rejected sketches as "pre-posed."

​

​Commissioner

-The customer may upload the work done for them to their site. It is not required, but credit and a link to my gallery is very appreciated. Once a piece is paid for, you may use it for any personal use that you please, including but not limited to icons, signatures, personal physical items, layouts, wallpapers, themes and personal site display. Please ask me if you are unsure if your use of my work breaks this terms of service.

-The customer may not claim that my artwork was made by themselves or someone other than me.

​

-The customer may make edits to the work I do for them.

​

-The customer may not commercially redistribute copies of my art unless given explicit permission. The customer may NOT resell the work for reproduction or be used for business promotion unless explicitly given permission by me. This includes but is not limited to: prints, t-shirts, mugs, charms, etc.

​

Character designs

-The customer may use the character design I have made for them in commercial endeavors, such as novels, blogs, videos, and video games.

​

-The customer may not claim a design I created was created by them unless significant changes have been made and I have approved it. Please contact me if you have made large changes to the design and wish to claim it as your own work.

​

Additional notes

-The customer may request the .psd or .kra file along with the final .png if desired.​ 

​

-I can prioritize your piece if you have a deadline, however, rush fees may be applied.

​

-I reserve the right to reject your commission without question.
